Maharashtra issues comprehensive guidelines to expedite recovery of dues; priority to MahaRERA Warrants

The Maharashtra government has issued comprehensive guidelines to speed up the recovery of outstanding dues, with MahaRERA recovery cases to be given priority. The new procedure is aimed at speeding up action against developers who have failed to pay amounts ordered by the Maharashtra Real Estate Regulatory Authority (MahaRERA) to homebuyers.

The Revenue Department issued the circular on August 25, 2026. It replaces the recovery guidelines issued in March 2012 and sets out the process to be followed by district collectors, sub-divisional officers and tehsildars during recovery proceedings.

1,421 MahaRERA Cases Involve Nearly ₹975 Crore

The move comes as 1,421 MahaRERA recovery cases across Mumbai City, Mumbai Suburban, Thane and Pune involve nearly ₹975 crore in outstanding dues. Around ₹350 crore has already been recovered from these cases, according to figures cited by officials.

Revenue authorities have been directed to take up MahaRERA recovery warrants on priority because the cases involve amounts payable to individual flat purchasers.

Recovery Certificates to Move Within Seven Days

Under the new procedure, recovery certificates received by collectorates must be scrutinised and forwarded to the concerned tehsildar within seven days. Tehsildars have also been instructed to take up MahaRERA recovery warrants on priority.

The tehsildar will then issue a demand notice giving the defaulter 14 days to clear the dues. Authorities can also seek an affidavit containing details of the defaulter’s movable and immovable properties.

Assets Can Be Traced and Auctioned

If the dues remain unpaid, authorities can begin proceedings to attach movable and immovable properties and proceed with an auction under the prescribed recovery process. Officials can use land records, registration and stamp records, RTO data and local body records to trace assets.

Recovery Cases to Be Monitored

Additional district collectors and resident deputy collectors have been designated as dedicated revenue recovery officers in some districts, including Mumbai, Thane and Pune. They will monitor cases and submit monthly reports covering recoveries, pending cases, outstanding amounts and reasons for delays.

The revised procedure places greater focus on timely processing and regular monitoring of MahaRERA recovery cases.
